Presidential Poll: Tribunal begins hearing on Atiku’s petition against Buhari


The Presidential Election Petition Tribunal sitting in Abuja, will on Wednesday, commence hearing on the petition the Peoples Democratic Party, PDP, and its candidate, Atiku Abubakar, filed to challenge the outcome of the February 23 presidential election.


The petitioners, are seeking to invalidate the declaration of President Muhammadu Buhari of the All Progressives Congress, APC, as winner of the presidential contest. Vanguard learned Tuesday night that a five-man panel of Justices of the Court of Appeal will conduct pre-hearing session on the petition Atiku and his party lodged before the tribunal on March 18. It was however not clear if the panel will be headed by the President of the Court of Appeal, Justice Zainab Bulkachuwa or by Justice Abdul Aboki who earlier made preliminary orders that compelled the Independent National Electoral Commission, INEC, to grant all the parties access to electoral materials that were used in the conduct of the election. Aside INEC, President Buhari and the APC were cited as Respondents in the petition. It will be recalled that the electoral body had on February 27, declared that Buhari won the presidential contest with 15,191,847 votes to defeat his closest rivalry, Atiku, who it said polled a total of 11,262,978 votes. However, in their joint petition, Atiku and his party, insisted that data they secured from INEC’s server, revealed that they defeated President Buhari with over 1.6million votes. The petitioners alleged that INEC had at various stages of the presidential election, unlawful allocated votes to President Buhari, saying they would adduce oral and documentary evidence to show that result of the election as announced by the electoral body, did not represent the lawful valid votes cast Atiku alleged that in some states, INEC, deducted lawful votes that accrued to him, in its bid to ensure that Buhari was returned back to office. The petitioners said they would call evidence of statisticians, forensic examiners and finger-print experts at the hearing of the petition to establish that the scores credited to Buhari were not the product of actual votes validly cast at the polling units. “The Petitioners plead and shall rely on electronic video recordings, newspaper reports, photographs and photographic images of several infractions of the electoral process by the Respondents”, they added. More so, in one of the five grounds of the petition, Atiku and the PDP maintained that Buhari was not qualified to run for the office of the President, contending that he does not possess the constitutional minimum qualification of a school certificate. The petitioners equally serialised results that were recorded from each state of the federation in order to prove that the alleged fraudulent allocation of votes to Buhari and the APC, took place at the polling units, the ward collating centres, local government collating centres and the State collating centres. They argued that proper collation and summation of the presidential election results would show that contrary to what INEC declared, Atiku, garnered a total of 18,356,732 votes, ahead of Buhari who they said got a total of 16,741,430 votes. “The Petitioners shall rely on the evidence of Statisticians, Forensic Examiners and other Experts, detailing the data analysis on the votes at all levels of collation, from the polling units to the final return”, he added. “The Petitioners state that Smart Card Readers deployed by the 1st Respondent, in addition to accreditation, equally transmitted electronically the results of voting from polling units directly to the server of the 1st Respondent. The Presiding Officers of the 1st Respondent directly inputted the results from the polling units at the end of voting and transmitted directly to the server, in addition to manually taking the Form EC8As to the Wards for collation. The 1st Respondent is hereby given notice to produce the records of results from each polling unit uploaded and transmitted electronically by officials of the 1st Respondent through smart card readers to the 1st Respondent’s Servers. “The Petitioners plead and rely on the 1st Respondent’s Manual Technologies 2019, and notice is hereby given to the 1st Respondent to produce same at the trial. The 1st Respondent’s agents at the polling units used the Smart Card Reader for electronic collation and transmission of results. The Petitioners plead and shall rely on and play at the trial, the video demonstration by the 1st Respondent of the deployment of Smart Card Reader for authentication of accreditation and for transmission of data. “The Petitioners hereby plead and rely upon the extract of data as contained on the 1st Respondent’s servers as at 25th February 2019, notice to produce whereof is hereby given to the 1st Respondent. The Petitioners also will rely on the data on the 1st Respondent’s central server between 25th February 2019 and 8th March 2019 and hereby also give notice to produce same before this Honourable Court. “The Petitioners hereby plead the electronic data on the servers of the 1st Respondent and shall at the trial give evidence of the source of the data analysis and data material, including the website: www.factsdontlieng.com. “The 1st Respondent had on the day of election published the total number of registered voters in the entire Country as 84,004,084. Subsequently, the same 1st Respondent published a different figure of 82,344,107 as registered voters, leading to an unexplained difference of 1,659,977 registered voters. The 1st Respondent equally published the number of permanent voter’s cards (PVC) collected for the purpose of the presidential election as 72,775,502. “The Petitioners state that whereas the actual number of voters accredited at the election was 35,098,162, the 1st Respondent wrongly suppressed and/or reduced the number of accredited voters to 29,394,209 to the detriment of the Petitioners. “The 1st Respondent had by its Regulations and Guidelines for the Conduct of Elections, 2019 made pursuant to the Electoral Act, 2010 (as amended) provided for the mandatory use of card readers for the said election. The 1st Respondent by its press release on smart card readers issued in February 2019 and signed by its National Commissioner, Barrister Festus Okoye, emphasised and reiterated that “The use of the Smart Card Reader is NOT ONLY MANDATORY but its deliberate non-use attracts the sanction of possible prosecution of erring officials in accordance with the INEC Regulations and Guidelines for the conduct of elections. “This is in addition to the voiding of any result emanating from such units or areas as was done in the Presidential and National Assembly elections of February 23, 2019.” By this stated position of the 1st Respondent, all accreditation not done by smart card reader in the presidential election was and remain void. “The Petitioners state and contend that the 2nd Respondent was not duly elected by majority of lawful votes cast at the election; and that from the data on each State of the Federation and the Federal Capital Territory, Abuja, in the 1st Respondent’s server, the 1st Petitioner, as opposed to the 2nd Respondent, scored majority of lawful votes cast at the election. “Wherefore, the Petitioners pray jointly and severally against the Respondents as follows:- “That it may be determined that the 2nd Respondent (Buhari) was not duly elected by a majority of lawful votes cast in the said election and therefore the declaration and return of the 2nd Respondent by the 1st Respondent as the President of Nigeria is unlawful, undue, null, void and of no effect. “That it may be determined that the 1st Petitioner (Atiku) was duly and validly elected and ought to be returned as President of Nigeria, having polled the highest number of lawful votes cast at the election to the office of the President of Nigeria held on 23rd February 2019 and having satisfied the constitutional requirements for the said election. “An order directing the 1st Respondent to issue Certificate of Return to the 1st Petitioner as the duly elected President of Nigeria.

Former lovebirds and Big Brother Naija “Double Wahala” contestants, Tobi Bakre and CeeC have been at loggerheads ever since the Big Brother Naija show ended in 2018.    

Then on Friday March 22nd, when the fifth episode of the reunion show aired, CeeC made a big revelation when Ebuka had a discussion with only the female ex-housemates. She calmly revealed how Alex had sex with Tobi whilst in South Africa yet kept telling her that they were just besties.

U.S. President, Donald Trump has declared that the Islamic State of Iraq and Syria (ISIS) will be eliminated from its last territory in Syria today.  

Trump, who spoke at the White House, announced that the last of the Islamic State’s territory in Syria was currently being liberated by US-backed forces and that the situation would be resolved “by tonight.’’  

While holding maps of ISIS’ territory in Iraq and Syria before and after his election, Trump pointed to a very small portion of the map that was currently being held by the terrorist group. The U.S. leader declared that by the end of Thursday, “the mission will be complete”.  
“I brought this out for you because this is a map of everything in the red, this was on election night in 2016. Everything red is ISIS. When I took over, it was a mess.
Now, on the bottom, that’s the exact same: There is no red. In fact, there is actually a tiny spot, which will be gone by tonight. So this is ISIS on Election Day, my Election Day, and this is ISIS now. So that’s the way it goes. This just came out 20 minutes ago,’’ he said.  

Trump later showed off the maps on his Twitter handle comparing the territory ISIS seized before his election in 2016, and the small portion the terrorist group now occupied. “ISIS Caliphate two years ago in red vs. ISIS Caliphate TODAY. (Was even worse in November 2016 before I took office)”, Mr Trump tweeted.

The Independent National Electoral Commission (INEC) has announced the scheduling of supplementary elections in Rivers State for April 13th 2019.

Announcing this at a press briefing in Abuja on Thursday, Festus Okoye, INEC commissioner for information and voter education, also said collation and announcement of results already generated, will be done between April 2 and 5, 2019.  

He added that issuance of certificate of return will be done on April 19.

Embattled R&B singer, R. Kelly, has asked a judge to let him travel to the Dubai to perform at several concerts, saying he has struggled to get work in the US and he's in need of money to help pay his mounting legal fees and child support bills. 

The 52-year-old singer through his attorney Steve Greenberg filed a motion asking a judge to allow the "I Believe I Can Fly" singer to travel for work in Dubai.

Greenberg is expected to argue that the singer's job requires him to travel, and that a recently denied performance permit in the U.S. proves he needs to be able to travel outside of the U.S. to earn a living.

Kelly is requesting to travel via private jet because he "needs to pay his day to day living expenses," as well as the excessive costs of child support and other child-related expenses, and a money judgment against him for back rent on his Chicago studio, according to ABC13.

On February 15th, BBNaija star, Alex Osugwo, turned 23 years old. Her friend, Swanky Jerry on his birthday message to her which he shared on his IG page, revealed that Alex rejected a 2018 Range Rover from a certain person who gave it to her as a birthday gift.

In a fresh interview with Punch, Alex gave reasons for rejecting the car many would die to have. According to her, 
“I rejected the first car I received on my birthday. For me, it was not just about the gift but where it was coming from. The second car given to me was from love. Responsible fans put their money together to get me the car, while the former was from someone who liked me. It is okay to like me but I didn’t feel it was right to collect a car from an admirer. He could decide to collect the car from me anytime he felt like. If I collected the car and I told him I didn’t want a relationship later, what would happen?”.
Speaking further, she said
“The man felt I was too proud when I rejected the car gift. But I am not a proud lady. I know many girls will take the vehicle; it was a 2018 Range Rover (for crying out loud). But I am Alex Unusual; I am not the type who can be wooed with material things.”

A crocodile, which was believed to have killed an Indonesian plantation worker eight days ago, has been caught and culled with the help of a bomoh, a spokesman of the Fire and Rescue Department (Bomba) said on Sunday, March 17.
He said the reptile’s stomach was sliced open by the police and the Sarawak Forestry Corporation officers to see if there were human bones inside

Pieces of human bones and torn clothes, believed to be those of Indonesian Yosep Tesu were found inside the stomach of the five-metre crocodile, the spokesman said.
He added that seeking assistance from the local bomoh was a last resort by the search and rescue team.
“After eight days of fruitless search, the police then decided to seek the assistance of the bomoh,” he said.

He said the monster had taken the bomoh’s bait attached to a hook laid at a place about five kilometres from the spot at a riverbank where Yosep was said to have eased himself.
An Indonesian worker had lodged a report with the Bintangor police, saying that his colleague had not returned after easing himself at the bank of a river at Zumida Oil Palm Sdn Bhd plantation about 4.30pm on March 10.

A search and rescue team consisting of the police, Bomba, Sarawak Forestry Corporation, Zumida Oil Palm and the villagers was then formed.

The Peoples Democratic Party PDP has said that its candidate in the February 23rd presidential election, Atiku Abubakar, beat its main contender and incumbent, President Buhari, by 1.6 million votes. Punch reports that the party stated this in a petition it filed before the Presidential Election Petitions Tribunal in Abuja on Monday March 18th.

INEC had on February 27, 2019 declared that Buhari won the election with 15,191,847 votes to defeat Atiku, whom it said polled 11,262,978 votes.

However, the party's petiton stated that “from the data in the 1st respondent’s (INEC’s) server…the true, actual and correct results” from “state to state computation” showed that Atiku polled a total of 18,356,732 votes to defeat Buhari whom they said scored 16,741,430 votes''.
The opposition party said the results were the total votes scored by the candidates in 35 states and the Federal Capital Territory Abuja, as there was “no report on sever” about the results from Rivers State as of February 25, 2019.
By this, Atiku claims to have defeated Buhari with 1,615,302 votes.
The five grounds of the petition reads
“The 2nd respondent (Buhari) was not duly elected by the majority of lawful votes cast at the election. The election of the 2nd respondent is invalid by reason of corrupt practices. The election of the 2nd Respondent is invalid by reason of non-compliance with the provisions of the Electoral Act, 2010 (as amended). The 2nd respondent was at the time of the election not qualified to contest the said election.
“The 2nd respondent submitted to the 1st Respondent an affidavit containing false information of a fundamental nature in aid of his qualification for the said election.”
On the grounds that President Buhari isn't qualified to run for the seat of president, the party said
“The 2nd respondent (Buhari) does not possess the educational qualification to contest the election to the office of the President of Federal Republic of Nigeria.
“The petitioners state that by Section 31 (1) of the Electoral Act, 2010 (as amended), every political party shall not later than 60 days before the date appointed for a general election submit to the Commission in the prescribed form the list of the candidates the party proposes to sponsor at the elections.
“Further, by Section 31(2) of the Electoral Act, 2010 (as amended), the list or information submitted by each candidate shall be accompanied by an affidavit sworn to by the candidate at the Federal High Court, High Court of a State or Federal Capital Territory indicating that he has fulfilled all the constitutional requirements for election into that office.
“The 2nd respondent filled and submitted Form CF001 to the 1st Respondent, which was declared before the Commissioner for Oaths at the Registry of the High Court of the Federal Capital Territory, Abuja on the 8th day of October, 2018. The said Form CF001 is accompanied by an ACKNOWLEDGEMENT indicating that the 1st Respondent received same.
“The petitioners aver that the said Form CF001 filled by the 2nd Respondent and submitted to the 1st Respondent for the Office of President was also accompanied by the Curriculum Vitae of the 2nd Respondent as well as GENERAL FORM OF AFFIDAVIT duly sworn to by the 2nd respondent at the High Court of the Federal Capital Territory, Abuja, along with copies of his Membership Card of the 3rd Respondent and Voter Card.
“The information submitted to the 1st respondent (INEC) by the 2nd respondent (Buhari) is false and of a fundamental nature in aid of his education qualification, notwithstanding that he had declared in the said sworn affidavit as follows: ‘I hereby declare that all the answers, facts and particulars I have given in this Form, are true and correct and I have to the best of my knowledge, fulfilled all the requirements for qualifications for the office I am seeking to be elected’.”
The party argued that the educational institutions President Buhari claimed to have attended and the certificates presented by him namely, Elementary School Daura and Mai Aduaa between 1948 and 1952, Middle School Katsina between 1953 and 1956 and Katsina Provincial College (now Government College, Katsina) between 1956 to 1961 and mentioned by the 2nd respondent in his curriculum vitae attached to Form CF 001, were not in existence as of  those mentioned dates.”
Names of 21 Senior Advocates of Nigeria and 18 other lawyers appeared on the petition.
The legal team is led by Mr Livy Uzoukwu (SAN).
They sought among their five main prayers, that the tribunal should determine that Buhari “was not duly elected by a majority of lawful votes cast in the said election” and therefore his declaration and return by INEC “as the President of Nigeria is unlawful, undue, null, void and of no effect”.
They also prayed that Atiku having been “duly and validly elected” ought to be “returned as President of Nigeria, having polled the highest number of lawful votes cast at the election to the office of the President of Nigeria held on February 23, 2019 and having satisfied the constitutional requirements for the said election.
They sought “an order directing the 1st respondent (INEC) to issue a Certificate of Return to the 1st petitioner (Atiku) as the duly elected President of Nigeria”.
They also asked the tribunal to rule that Buhari “was at the time of the election not qualified to contest the said election”, and that he “submitted to the Commission affidavit containing false information of a fundamental nature in aid of his qualification for the said election”.
However, they sought as their alternative prayer, “that the election to the office of the President of Nigeria held on February 23, 2019 be nullified and a fresh election ordered.”
The petitioners are relying on 50 sets of documents which they, in the petition, gave INEC the notice to produce the original copies of those in its custody.
Some of the documents are, “INEC Nomination Form CF001 of the 2nd respondent (Buhari); all INEC result sheets;(Form EC8 Series), EC8A, EC8B, EC8C, EC8D and EC8E – Certificate of Return; PDP Party Membership Cards; INEC Voter Cards; all witnesses’ party membership cards; and all Witnesses’ Voter Cards.”
The petitioners also sought to rely on, “the circulars/corrigenda/manuals issued by INEC for the conduct of the Presidential Election held on 23/2/2019; Polling Unit materials checklist; summary of total registered voters on units’ basis; summary of PVCs collected on units’ basis; Voter Registers and letters of complaints over irregularities and malpractices during the election addressed to the INEC/Police/other relevant agencies/institutions.”
They also sought to rely on “security reports relating to the election video/audio recordings/DVD/CD relating to the Election; Election Observers’ or Observers’ Reports; Newspaper/Television/ Radio reports and news; appointment letters and tags of PDP agents; expert reports and analysis; and photographs and GSM and other phone outputs”

Social media is agog this morning with the story of a Covenant University student who faked her kidnap so she can go to Ibadan to meet her boyfriend. To make matters worse, all the while she was with her boyfriend, he was one of those tweeting for people to help find her.

The lady named Damilola went from Lagos to Ibadan to see a Mark Ikotun. Friends and family feared she had been kidnapped and they issued a missing person alert. The boyfriend she was with also led the search for her on social media and was begging for her return.

She later returned claiming she had been kidnapped and raped, causing her friends and family distress.
But it was later discovered that she staged her kidnap with her boyfriend. Now, her friends are calling her out on social media.

Labour Party sues INEC over exclusion from fact-finding meeting In Rivers State
Labour Party has filed a suit against the Independent National Electoral Commission (INEC) over its exclusion from a meeting with the fact-finding committee sent to Rivers State to investigate the irregularities that marred elections in the state.  

In a suit filed before a Federal High Court sitting in Abuja on Tuesday marked FHC/AB/306/2019, the Labour Party and its governorship candidate in the March 9 governorship and house of assembly elections, Isaac Wonwu, are praying to court to determine whether INEC was right to have excluded them from meeting INEC’s fact-finding team that was sent to the state to look into the disputes arising from the polls.  

The party is also praying the court to stop the electoral body from proceeding, as it had announced, with the resumption and declaration of the results of the polls until the matter has been determined.  

INEC has scheduled Wednesday, March 20, 2019, for the announcement of the result of the March 9 elections held in the state.

'I love you no matter what' - R Kelly wishes his enstranged daughter 'Happy Birthday' despite being branded a 'Monster' by her



R. Kelly has just sent birthday wishes to his eldest daughter on her 21st birthday today.  

The embattled singer dropped a “Happy Birthday” song to Joann Kelly, his daughter with ex-wife Drea Kelly making it the first time he’s tweeted anything since January 1.

Joann, who performs under the stage name Buku Abi, had been quiet on the controversy surrounding her father until earlier this year, when she made a lengthy statement. “My choice to not speak on him and what he does is for peace of mind. My emotional state. And for MY healing,” Joann said back in January, adding that it has been very “difficult to process it all.”

However, Kelly is still reaching out to his daughter, especially after paying off his six-figures in back child support. After singing the birthday song, Kelly told his daughter, “I love you … no matter what, I love you so much.”
